An unusual Oregon libel case recently captured the attention of the blogosphere and mainstream press. In late November, blogger Crystal Cox was hit with a $2.5 million verdict for defaming Obsidian Finance Group and its principal. Obsidian Finance Group, LLC v. Cox, Case No. CV-11-57-HZ, 40 Media L. Rep. 1084 (D. Ore. Nov. 30, 2011) (Hernandez, J.). More notable than the size of the judgment against the pro se defendant was the court?s controversial discussion of?who is to be considered a journalist in the online sphere, in order to determine whether statutory or First Amendment protections applied to the blog in question.

In January 2012, Cox filed a Motion for New Trial and in the alternative, for Remittitur. The motion, co-authored by leading First Amendment scholar Professor Eugene Volokh of UCLA Law School,?argues that the jury should have been instructed, consistent with New York Times Co. v. Sullivan, that it could find defendant liable only if she acted with ?actual malice.??Alternatively, even if the Sullivan standard did not apply, the motion argues the jury should have been instructed, consistent with Gertz v. Robert Welch, Inc., that it could hold defendant liable for proven compensatory damages only if it found that defendant acted negligently, and that it could hold defendant liable for presumed damages only if it found that defendant acted with ?actual malice.? The motion also argues that the?evidence presented to the jury did not support $2.5 million in damages,?whether?proven or presumed, arising from the single Internet post considered at trial.

The motion is supported and supplemented by an amicus curiae brief filed by the Electronic Frontier Foundation. That brief additionally challenges the court?s ruling that?Oregon?s retraction statute does not apply to the Internet, and that because defendant Cox was not a member of the ?media,? Oregon?s shield law does not apply.

Background

The Obsidian Finance saga began in earnest last summer with U.S. District Court Judge Marco Hernandez?s denial of plaintiff?s motion for partial summary judgment on liability regarding the 10 blog entries submitted. Despite the fact that Cox was unrepresented and filed little relevant opposition, the court on its own held that?plaintiffs failed to address ?the obvious First Amendment issues raised by defendant?s statements??and that ?defendant?s statements are expressions of opinion protected by the First Amendment.? The court added that although Cox had not moved for summary judgment, it would sua sponte grant summary judgment for her, pursuant to F.R.Civ.P.56(f), unless plaintiffs successfully opposed that conclusion.

In response, plaintiffs newly submitted 16 different blog entries.?The court again found that all were ?protected by the First Amendment? because ?no reasonable juror could conclude that the statements contained provable assertions of fact.? With?regard to one?newly submitted?post,?however, the court concluded that ?reasonable readers could?reach differing conclusions about whether the statements contain or imply an assertion of objective facts.? While nearly all of the posts were made on a single website, the post in question appeared on a different website. The court noted that it was one of only two postings submitted by plaintiff from that site, and therefore ?a full assessment of the flavor or tenor of the website is not possible.?

While the court noted that the post in question contained ?several none-provable, figurative or subjective-type words which tend to negate the impression that defendant asserts provable statements of fact,? because so little material from the website was presented by plaintiffs, the court found that it could not ?collectively examine the surrounding posts to determine the frequency with which defendant uses these words.? The court added that ?while the post is somewhat confusing and uses some?unclear terms such as ?liquidating trust,??it reads more like a factual narrative? than the other 25 posts plaintiffs provided.

The court held that the context of the post in question ?does not necessarily negate the impression that the statements are incapable of being proved true or false. On the one hand, a reasonable reader may view the title of the website [bankruptcycorruption.com], the fact that the statements appear on a blog, and the use of loose, figurative language, as dispelling such impression. However, ? a different reader could reasonably understand the statements to imply provable assertions of fact.??The case proceeded to trial on this single post.

Just before trial, the court ruled on a number of legal issues. First, defendant argued that plaintiffs were precluded from general damages because plaintiffs had?failed to seek a retraction in accordance with the requirement of Oregon?s retraction statute.

The court held that??because the statements at issue in this case were posted on an Internet blog, they do not fall under Oregon?s retraction statutes.??

The statute, enacted in 1955, applies to ?a defamatory statement published or broadcast in a newspaper, magazine, other printed periodical, or by radio, television, or motion pictures.? While there are no appellate decisions, Oregon?s state trial courts?have frequently applied the retraction statute to Internet statements made by traditional newspapers and broadcasters.

The court also held that?Oregon?s shield law did not apply to defendant?in the first instance because??the record fails to show that she is affiliated with any newspaper, magazine, periodical, book, pamphlet, news service, wire service, news or feature syndicate, broadcast station or network, or cable television system.?

The Oregon shield applies to?any ?medium of communication,? which includes, but is not limited to, the litany of particular media the court listed.?The brief submitted by Electronic Frontier Foundation challenges the court holding that Cox?s status as an Internet publisher precluded her from shield law protection.

Most significantly, the court held that?because the individual plaintiff, a bankruptcy trustee, was not a public figure??actual malice? did not apply?and, because?the defendant was not ?media? even the negligence standard of Gertz was not triggered.

The court found that defendant failed to bring forth any evidence ?suggestive of her status as a journalist,? citing ?no evidence of (1) any education in journalism; (2) any credentials or proof of any affiliation with any recognized news entity; (3) proof of adherence to journalistic standards such as editing, fact-checking, or disclosures of conflicts of interest; (4) keeping notes of conversations and interviews conducted; (5) mutual understanding or agreement of confidentiality between the defendant and his/her sources; (6) creation of an independent product rather than assembling writings and postings of others; or (7) contacting ?the other side? to get both sides of a story.?

The court also rejected the argument that the blog??referred to a matter or issue of public concern, further implicating First Amendment protections.??The court held that ?similarly to the plaintiff?s status as a lawyer in Gertz [plaintiff?s] status as?a bankruptcy trustee does not make statements about his actions in that role a matter of public concern.? The jury instructions therefore allowed them to find for plaintiffs simply if the defendant published a defamatory communication which damaged them."

JPMorgan profit jumps 34 percent on mortgage lending surge

(Reuters) - JPMorgan Chase & Co posted a record quarterly profit on Friday as falling interest rates and a recovering housing market brought big increases in mortgage lending.

The mortgage market, long a drag on bank results, is starting to lift lenders' earnings again, and JPMorgan Chief Executive Jamie Dimon said he was hopeful about the outlook for U.S. residential real estate.

"We believe the housing market has turned the corner," Dimon said in a statement.

JPMorgan suffered only modest losses in the latest quarter from the "London whale" trades that brought it $5.8 billion of losses in the first half of the year, signaling that it is moving on after the scandal.

The improving housing market brought the bank a 36 percent increase in mortgage lending revenue in the third quarter.

Analysts expect mortgage lending volume to continue to rise after the Federal Reserve said in September that it would buy up to $40 billion of mortgage bonds every month until the labor market improved materially.

That announcement from the Fed has lowered mortgage rates. According to the Mortgage Bankers Association, applications for home loans jumped 16.6 percent in the week ended September 28 from the week before.

Wells Fargo & Co also benefited from the mortgage bonanza, posting a 22 percent increase in third-quarter profit on Friday.

The Fed's buying program also lifted JPMorgan's profits in fixed-income trading, which rose 33 percent, excluding adjustments for changes in the value of the bank's debt. That increase could bode well for other big investment banks due to report results over the next week, including Goldman Sachs Group Inc and Morgan Stanley.

JPMorgan's third-quarter net income was $5.71 billion, or $1.40 a share, up from $4.26 billion, or $1.02 a share, a year earlier.

Analysts had expected, on average, $1.24 a share, according to surveys by Thomson Reuters I/B/E/S. It was not immediately clear whether the analyst forecast was comparable to the reported results.

Profits at JPMorgan's investment bank, excluding accounting adjustments for changes in the value of JPMorgan debt, rose to $1.7 billion from $1.2 billion a year earlier, when the European debt crisis cast a darker shadow over the capital markets.

JPMorgan shares were little changed in morning trading. Through Thursday the shares were up 27 percent this year, almost twice the rise in the Standard & Poor's 500 stock index but about three percentage points less than the KBW Bank stock index.

The bank set aside an additional $684 million, before taxes, in the third quarter to cover legal settlements and judgments. A year earlier, it boosted its legal reserves by $1 billion.

JPMorgan was sued last week by the New York state attorney general over allegations that Bear Stearns, salvaged by the bank in a 2008 takeover assisted by the government, had deceived investors buying mortgage-backed securities in 2006 and 2007. Though the allegations were similar to ones already made by private investors in civil suits, the lawsuit raised concerns among analysts that there are more litigation costs to come for JPMorgan and other banks.

Dimon on Wednesday said the lawsuit was "unfair" because JPMorgan had done the Fed "a favor" by taking over a broken Bear Stearns.

French president Hollande begins African tour

DAKAR, Senegal (AP) ? French President Francois Hollande will attempt to make right France's relationship with Africa on his first visit to the continent on Friday, beginning with a stop in Senegal, the seat of France's former colonial empire.

It is here five years ago that Hollande's predecessor, Nicolas Sarkozy, said the African man had "not yet entered history," in a speech that was viewed as deeply insulting to many on the continent.

The 58-year-old Hollande, who defeated Sarkozy in May, vowed on the eve of his departure "to write a new page in France's relations with Africa." However, he also said in the interview broadcast on French television and radio that he "is not coming to make a speech which will erase a precedent."

Analysts say he chose Senegal for his first visit to the continent due to the country's democratic credentials, and also because Senegal is expected to play a central role in the planned military intervention in neighboring Mali to flush out the Islamic extremists controlling north Mali. For the Senegalese though, what is front and center is the memory of Sarkozy's 2007 speech.

Africans were seething for weeks after the speech in which he said: "The tragedy of Africa is that the African man has not fully entered into history ... They have never really launched themselves into the future," Sarkozy said. "The African peasant only knew the eternal renewal of time, marked by the endless repetition of the same gestures."

People attending his remarks, which were delivered at Dakar's largest public university, were so insulted that some walked out in a huff.

"Sarkozy came with contempt and with scorn. Hollande is coming to clean up," says Yero Dia, a political analyst who is a frequent commentator on TV debate shows in Senegal. "But for me it's not about Sarkozy, nor about Hollande. It's about us, Africans. It's like the horse and the rider. Whether it's Mitterand, or Chirac, or Sarkozy or Hollande, what remains constant is the system. ... and nothing will change until Africans stop behaving like the horse and letting France be their rider."

Senegal was once the seat of the French empire in West Africa. The country won its independence from France in 1960, but maintains close ties with France.

Hollande will be in Dakar all day on Friday, where he will meet newly elected President Macky Sall, as well as deliver a speech at the National Assembly. In a departure from his predecessor, he will also visit Goree Island, off the coast of the capital, where slaves were boarded onto ships and sent to America. The visit to the slave museum is a symbolic gesture, underscoring Hollande's understanding of the difficult history that Africans have endured.

He is set to leave Friday night for Congo, where he will attend the Francophonie summit in the capital, Kinshasa.

On newsstands throughout Dakar, Senegal's lively independent press reminded Hollande of his predecessor's gaffe. "Be Frank with Us Hollande!" read the headline in Le Quotidien, a play on words because the term "franc" in French, meaning "frank," sounds like the president's first name, Francois. Walfadjiri, another newspaper, calls for "A new page."

Monitor Correspondent Liz Marlantes has some thoughts on how vice presidential debates don't matter.

On Wednesday, the conservative Daily Caller posted a blog about Ms. Raddatz, alleging bias because of her short-lived marriage in the 1990s to an Obama administration appointee, Julius Genachowski, the head of the Federal Communications Commission.

This shot comes on the heels of an avalanche of criticism aimed at last week?s presidential debate moderator, Jim Lehrer, ranging from GOP commentator Laura Ingraham to Democratic contributor Bill Maher.

?There have always been questions about moderators,? says Atlanta-based GOP strategist David Johnson, who consulted on Bob Dole?s 1988 presidential campaign. Targeting moderators is simply a political strategy, he says, giving ?each side a way to say, the debate was stacked against them if their candidates don?t do well.?

Mounting such a strategy before the debate even starts, Mr. Johnson adds, ?makes the moderators go out of their way to be evenhanded.?

In one of the GOP debates earlier this year, CNN?s John King took withering heat for asking Newt Gingrich about allegations made by his second wife. A variety of sources challenged Gwen Ifill?s objectivity in 2008 because she had written a book related to Barack Obama.

Now, both ABC News and the Commission on Presidential Debates have dismissed charges of bias against Raddatz, a senior foreign affairs correspondent. As reported in Politico Wednesday, The Washington Post?s conservative Jennifer Rubin tweeted that ?this whole mini flap was obnoxious, dumb.?

Still, taking down a particular moderator can have the beneficial result of lowering expectations, which can then be more easily exceeded, says Ed Uravic, a former?Washington?lobbyist and currently a faculty member at Harrisburg University of Science and Technology in Pennsylvania. ?It can potentially soften up the moderator and prevent her from hitting the candidate with hard or embarrassing questions (though that did not appear to work with Gwen Ifill, and she did seem to have a conflict given her book about Obama),? he writes in an e-mail.

Indeed candidates, and especially their surrogates, sometimes try to ?fire a shot over the bow? of a moderator to ensure the moderator?s objectivity, says presidential scholar Charles Dunn, dean of the Robertson School of Government at Regent University in Virginia Beach, Va. This is what ?Romney-Ryan surrogates have done to Martha Raddatz before the Biden-Ryan debate,? he writes in an e-mail. ?And sometimes afterward surrogates may to excuse their candidate?s poor performance by blaming it on the moderator, which Obama?s surrogate [deputy campaign manager] Stephanie Cutter did to Jim Lehrer.?

This is ?a way of working the refs, just the way the Green Bay Packers did,? says David Mark, editor in chief of the political news site Politix. ?It?s a way of saying, it wasn?t our fault because the ref was biased.?

Particularly with vice-presidential debates, Mr. Mark points out, ?this is a way of trying to win on the margins.? The vice-presidential candidates are not really talking about themselves, he notes, but rather ?are supposed to be talking up their bosses, so this is a way to distinguish themselves? from their opponent.

Moderators are an easy target partly because their role morphs each time out of the gate, points out Robert Thompson, founder of the Bleier Center for Television and Popular Culture at Syracuse University in New York. ?The role of the moderator gets to be made up by whoever has input on the format of the debate,? he points out. At first, Mr. Lehrer was dubbed the worst moderator in history, he says, but ?that view is changing.?

?Defenders of Jim Lehrer are saying a moderator should be invisible,? he notes. But others contend that ?moderators should insert themselves more into the process, controlling the back and forth and asking more aggressive questions,? Mr. Thompson says.

The scrutiny of the moderator also points to another growing trend, the elevation and, at times, polarization of the media in the political process, Johnson says. More than ever before in the history of mass media, he says, US media are no longer perceived as being objective. He points to a recent Pew poll that showed 60 percent of the public does not trust the media.

?The media is perceived as being part of the political process,? says Johnson, pointing to liberal and conservative cable channels such as MSNBC and Fox News. ?So it?s getting harder for the American public to believe that there isn?t bias going into these debates.?

Tapping into distrust and suspicion about the media helps stir up the Republican base, Johnson points out. ?So it?s not surprising to see it happening even before the debates take place.?

The Center of the American Experiment published a?report,?Fragmented Families and?Splintered Classes,?that addresses?growing class divisions?in America. The report asked thirty-six writers ? including Brad Wilcox and yours truly ? to respond to the following questions:

• How might abridged mobility and starker class divisions play out for lower-income and minority men, women, and, in particular, children?? What will it mean for their prospects?
• What about the commonweal itself?? In what centrifugal ways might all this play out in the nation?? In Minnesota?
• And getting to the core, what can be done to reduce out-of-wedlock births and divorce measurably in the first place?

Here is the essay that Brad and I wrote, in which we suggest that in order to?stop the splintering of classes,??we will need? to improve?and in some cases, revive?institutions that serve the 70? percent of non-college-educated Americans, particularly those that?direct them toward steady work, thrift, and marital commitment.?

I haven?t read the full report yet, but according to the prologue by Mitch Pearlstein, it includes contributions from a philosophically and politically diverse group of people. I look forward to reading it.

On a related note, one of the things that Brad and I did not mention in our essay are early childhood education programs,?which are touted by some people as essential for strengthening?low-income families. I confess I?ve never really given that much thought to these programs ??but perhaps I should. There?s an early childhood education center just a two minute walk from Amber and I?s home here in Maytown, which provides preschool, daycare, and Head Start programs. Amber and I just talked to young married couple with three children that love it because it?allows their?children?(all under the?age of 4?) a head start in eduaction, and it gives the parents flexibility?to work. I recall David Brooks?writing one time that early childhood education programs have proven results. If anyone knows of these studies,?I?d be interested in?looking at them.
